13 oktober 2021 – Gisteren verscheen in San Marino op de website libertas.sm het nieuws, dat in de “honkballenzaak” tegen de wereldbond WBSC in Lausanne het onderzoek lek is geraakt (“sgonfiare”).
Het artikel dd 07.56 uur is deze keer niet ondertekend door een journalist. Dit is in tegenstelling tot het vorig artikel, dat op 28 september werd geplaatst door de journalist Antonio Fabbri en de zitting van de rechtbank van de dag ervoor betrof. (Update: inmiddels staat de naam van Fabbri wel bij het artikel) Toen werd gesproken over witwassen in San Marino bij de aankoop van wedstrijdballen van het plaatselijke merk Teammate ter waarde van ongeveer 2 miljoen euro. Het bedrijf Teammate Sport International SRL is gevestigd in San Marino, het ministaatje nabij de Italiaanse badplaats Rimini.
Sneller dan Italiaanse nieuwsvolgers hadden verwacht (enkele maanden tot een half jaar), heeft volgens libertas.sm rechter Oliviero Mazza nu al na twee weken besloten wegens geen of onvoldoende bewijs de zaak tegen de WBSC te seponeren en de beslaglegging door de onderzoekscommissaris ter waarde van 258.300 euro op te heffen. Dit moet een opluchting zijn voor de twee WBSC-bestuurders, die qua functie en qua woonachtigzijn nauw betrokken zouden zijn geweest bij de gevolgen van een andere afloop van het justitieel onderzoek, te weten de Italiaanse voorzitter Riccardo Fraccari en diens penningmeester Angelo Vicini uit San Marino zelf. Vandaag schreef de WBSC de volgende brief aan alle nationale bonden aangesloten bij deze wereldbond:

On September 28, 2021, the San Marino daily newspaper L’Informazione published an article (summarised and subsequently disseminated by some online information sites) concerning the alleged involvement of the World Baseball Softball Confederation and some of its executives in money laundering and other related activities with the Panama Baseball Association in relation to the alleged purchase of baseball balls from the company Teammate Sport International SRL, a WBSC partner organisation, which resulted in the simultaneous precautionary seizure of the sum of E. 258.300 by the San Marino Judicial Authority.
Following a public hearing held on 27 September 2021, the judge for the Third Penal Instance of San Marino accepted the appeal presented on behalf of the WBSC by lawyer Elia Santi on 28 June 2021, ordering the release of the sum seized.
The above mentioned ruling dated 6 October 2021, accepting the arguments made by the defence, recognizes how “the motivation (of the contested provision) appears to be radically deficient also in the terms of the existence of the circumstantial gravity” as well as “lacking even the slightest argumentative support and was ultimately of a purely conjectural nature”. The judge therefore deemed the contested provision illegitimate, ordering its annulment as well as the immediate return to the WBSC of the sum of E. 258.300.
The WBSC reserves the right to take further action against those responsible for the disclosure of incorrect and damaging information.
